Automated Messages and Emails:

You will be receiving messages regarding your optin confirmation, booking confirmation and appointment reminders. Apart from this you will not receive any automated messages or emails.

Unsubscribe:

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To cancel the appointment. Simply text "Cancel" to the shortcode and you will receive a confirmation regarding your cancelled appointment

Support:

As always, message and data rates may apply for messages sent to you from us and to us from you. You will receive 5 messages 36 prior the appointment and one each upon optin and appointment no-show/cancel. For questions about your text plan or data plan, contact your wireless provider.

These Terms & Conditions (“Terms”) govern the use of services offered by Art City Auto Body (“Art City Auto Body,” “we,” “us,” or “our”) including websites, digital marketing services, software implementations, automations, consultations, and all custom-built deliverables provided to clients (“you,” “your”).

By engaging with Art City Auto Body or using any of our Services, you agree to these Terms.

Welcome to Volkis.app (“Volkis”). These Terms of Service (“Terms”) govern your access and use of our software, tools, and related services (the “Service”). By creating an account, subscribing, or using the Service, you agree to be bound by these Terms.

1. Definitions

“Company,” “we,” “us,” or “our” refers to Volkis.app.

“Service” refers to the Volkis software platform, including all tools, features, credits, and resources.

“User,” “you,” or “your” refers to the individual or entity using the Service.

2. Use of Service

2.1 Eligibility. You must be at least 18 years old to use the Service.

2.2 Account Registration. You agree to provide accurate and complete information when registering for an account.

2.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Telephone Communications and Marketing Consent

3.1 Consent to Receive Calls

By providing your phone number to Volkis through any channel (including but not limited to webinar registrations via WebinarJam, software sign-ups, contact forms, support requests, or any other lead generation forms), you expressly consent to receive marketing and informational calls from CodeSpring to that number. This includes:

Live calls from our team members

Marketing and promotional calls about our products and services

Webinar follow-up calls and reminders

Customer service and support calls

Informational calls related to your account or services

Important: Your consent is not a condition of purchase. Standard telephone rates may apply. We will not sell or share your phone number with third parties for their marketing purposes without your separate express consent.

3.2 Identification and Disclosures on Calls

We commit to the following standards for all calls:

Every call will immediately identify Volkis as the calling party

We will provide a valid callback number

We will clearly state the purpose of our call

Our caller ID will accurately represent Volkis and will not be spoofed

We maintain truth-in-caller-ID compliance at all times

3.3 Calling Hours and Frequency

We adhere to strict calling hour limitations and frequency caps:

Federal Baseline: 8:00 AM to 9:00 PM in your local time zone

Our Practice: 10:00 AM to 6:00 PM in your local time zone (stricter standard)

Days: Monday through Saturday, excluding federal holidays

Frequency Limits: Maximum of 3 call attempts per 24-hour period for the same subject matter

State-Specific Compliance: Where state laws impose stricter windows or caps, we follow the stricter requirement

3.4 Do-Not-Call Registry and Opt-Out Handling

We maintain comprehensive Do-Not-Call compliance:

We screen all numbers against the National Do-Not-Call Registry before calling

We maintain an internal Do-Not-Call list of users who have opted out

We honor any reasonable opt-out request through any communication channel

Opt-out requests are processed within 24-48 hours (well within the 10 business day requirement)

Do-Not-Call requests are retained and enforced across all future campaigns

Opt-Out Methods: You may revoke consent at any time through:

Verbal request during any call with our representatives

Text reply “STOP” to any message from us

Written request to our registered business address

3.5 Consent Record-Keeping

We maintain comprehensive records for compliance purposes:

Timestamp and source of consent (e.g., WebinarJam registration, website form)

Screenshot or URL of the consent language displayed at time of collection

IP address and user agent information

Consent language version in effect at time of collection

All opt-in and opt-out requests with timestamps

Records retained for minimum 5 years to align with litigation risk and compliance requirements

3.6 Scope and Purpose of Calls

Calls will be limited to purposes relevant to your opt-in context:

WebinarJam registrations: webinar reminders, follow-ups, and related offerings

Software sign-ups: onboarding, support, and product information

Contact forms: responding to inquiries and providing requested information

Marketing communications about Volkis products and services

3.7 State-Specific Compliance

We comply with all applicable state-specific telemarketing laws, including but not limited to:

Mini-TCPA laws in Florida, Oklahoma, Texas, Maryland, Connecticut, and other states

State-specific calling time restrictions

Daily contact frequency limitations

Enhanced consent requirements where applicable

Where state and federal rules differ, we follow the stricter requirement to ensure full compliance.

3.8 Geographic and Jurisdiction Application

For calls to US phone numbers:

We apply the laws of the recipient’s location

We detect and enforce local time zones for all US recipients

We apply state-specific rules based on the area code and recipient location

As a UK-based company, we follow US TCPA/TSR rules when contacting US numbers, not UK TPS/CTPS norms

3.9 Complaint Handling and Escalation

For Do-Not-Call or opt-out issues:

We provide opt-out confirmation upon request

We maintain complaint logs for regulatory compliance

3.10 Enforcement and Suspension Rights

We reserve the right to:

Suspend communications to numbers with potential consent defects

Cease calling numbers with excessive complaints or regulatory risk

Update our calling practices to maintain compliance with evolving regulations

Terminate calling campaigns that present compliance risks

4. Intellectual Property

4.1 Ownership. All content, software, text, graphics, logos, and related materials within the Service are owned by or licensed to Volkis.

4.2 License. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal or business purposes, subject to these Terms.

4.3 Restrictions. You may not:

Reproduce, copy, or redistribute the Service or its content;

Reverse engineer, decompile, or attempt to derive the source code;

Rent, lease, or sublicense the Service.

5. User Content & Derivative Works

5.1 Your Content. Any applications, documents, or materials you create using Volkis are yours. We claim no ownership over your output.

5.2 Limitations. You may not resell, redistribute, or sublicense access to the Service itself, or share your account with others.

6. User Conduct

You agree not to:

Use the Service for unlawful purposes;

Violate third-party intellectual property rights;

Attempt to gain unauthorized access to the Service;

Upload or transmit malicious code, bots, or automated scraping tools.

7. Payments, Refunds & Cancellations

7.1 Subscription Fees. The Service is provided on a recurring subscription basis (monthly or yearly) and renews automatically unless cancelled before the next billing date.

7.2 No Refunds. All subscription sales are final. We do not issue refunds for change of mind, lack of usage, or brief trial periods. See our Refund & Cancellation Policy for details.

7.3 Cancellation. You may cancel your subscription at any time through your account settings. You will retain access until the end of your current billing period. No partial refunds are provided.

7.4 Digital Waiver. By subscribing, you request immediate access to the Service and waive your statutory 14-day right of withdrawal under the Consumer Contracts Regulations 2013.

8. Support & Disputes

8.2 Direct Resolution Required. You agree to contact us through the above channels and allow us a reasonable opportunity to resolve any issues before initiating chargebacks or third-party disputes.

8.3 Prohibited Resolution Methods. Payment platform “resolution cases” are not considered valid support requests. Initiating disputes outside our support process may result in suspension or termination of your account.

8.4 Chargebacks. By using the Service, you agree not to initiate chargebacks for services delivered or accessible. If you do, we may suspend or revoke your account, recover fees, and apply a £29 administrative charge where permitted.

9. Third-Party Costs & Integrations

The Service may integrate with third-party tools or APIs. You are responsible for any fees charged by those third parties (e.g., hosting, data services, external APIs).

10. Disclaimer of Warranties

10.1 The Service is provided “as is” and “as available.”

10.2 We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10.3 We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

11.1 To the maximum extent permitted by law, Volkis shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

11.2 Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Volkis from any claims, damages, or expenses (including legal fees) arising out of:

Your use of the Service;

Violation of these Terms;

Infringement of any third-party rights.

13. Governing Law & Jurisdiction

13.1 These Terms are governed by the laws of England and Wales.

13.2 You agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes arising under these Terms.

13.3 For telephone communications to US recipients, we comply with US federal and state telecommunications laws as described in Section 3.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. Material changes affecting telephone communications will be highlighted.
